The Department of Justice's Civil Rights Division and Department of Health and Human Services' Office for Civil Rights last week issued technical guidance for medical facilities on the Americans with Disabilities Act and Section 504 of the Rehabilitation Act. The 19-page document includes an overview of ADA requirements, commonly asked questions, and examples of accessible facilities, examination rooms and medical equipment. Title III of the ADA prohibits discrimination on the basis of disability by private hospitals, doctors' offices, clinics and other health care providers. Section 504 of the Rehabilitation Act of 1973 prohibits disability-based discrimination by health care providers that receive federal financial assistance.
